By placing an order, you are entering into a contract of sale directly with the Seller identified above. ECUALAMA INC acts as a platform operator and commercial agent for the Seller.

 

TERMS OF SERVICE

1. WHO WE ARE AND WHO SELLS THE GOODS

1.1 Website / Platform Operator. The Site is operated by ECUALAMA INC (“ECUALAMA”, “we”, “us”, “our”).

1.2 Seller of the Goods (“Seller”). ECUALAMA INC does not sell the Goods as principal unless expressly stated at checkout. The seller of record is the person or business identified as the seller at checkout and on your invoice/order confirmation (and, where applicable, on shipment documents). As noted above, the default Seller for products on this Site is the Ecuador-based entity identified in the "Seller of Record Information" section.

1.3 Contracting Party. The contract for the purchase of Goods is between you and the Seller. ECUALAMA INC provides a platform and related services (including website operation, marketing, and customer support coordination) but is not a party to the sale contract unless explicitly stated at checkout.

If you do not agree with these Terms, do not use the Site or place an order.

 

 

2. ABOUT THESE TERMS

2.1 Scope. These Terms govern your access to and use of ecualama.com and related pages (the “Site”), and your interactions with ECUALAMA INC as the Site operator.

2.2 Sales by Sellers. Any purchase of Goods is governed by the sale contract between you and the Seller and any Seller policies presented to you at checkout or in your order confirmation/invoice.

2.3 Non-excludable rights. Nothing in these Terms limits any rights that cannot be excluded under applicable law.

 

 

3. ELIGIBILITY AND ACCOUNTS

3.1 Capacity. You must have legal capacity to enter into contracts in your jurisdiction.

3.2 Account security. If you create an account, you are responsible for maintaining the confidentiality of your login and all activity under your account.

 

 

4. PRODUCTS AND INFORMATION

4.1 Descriptions. We and/or the Seller aim to describe products accurately. Images are illustrative; colours/textures may vary due to screens and natural material variation.

4.2 Availability. Products may be limited. We may update product content and availability at any time.

 

 

5. PRICING, CURRENCY AND SHIPPING CHARGES

5.1 Prices. Prices are displayed in the currency shown on the Site.

5.2 Shipping charges. Shipping charges (if any) are shown at checkout and are included in your total amount payable.

5.3 Bank fees. Currency conversion and bank/card issuer fees are your responsibility.

 

 

6. ORDERS; FORMATION OF THE SALES CONTRACT

6.1 Order as an offer. When you place an order, you are making an offer to purchase Goods from the Seller.

6.2 Seller identified at checkout. Before you submit payment, the Site will identify (or provide a link to identify) the Seller for your order and the applicable Seller terms/policies.

6.3 Acceptance. The Seller may accept or decline your order. The sales contract is formed when your order is accepted (for example via order confirmation) or when the order is dispatched (depending on the Seller’s workflow).

6.4 Refusal/cancellation. We and/or the Seller may refuse or cancel orders where: products are unavailable; there are pricing errors; we suspect fraud/abuse; or the destination is restricted (see Section 8). If payment has already been captured, a refund will be arranged under the Returns/Refund Policy.

 

 

7. PAYMENTS

7.1 Payment processing. Payments are processed via third‑party payment processors and platforms (e.g., Shopify Payments, PayPal, card processors).

7.2 Collection on behalf of Seller. Depending on your payment method and destination, payments may be collected by ECUALAMA INC and/or an authorised payment processing partner acting for the Seller. Your bank/card statement descriptor may vary accordingly.

7.3 Chargebacks. If you initiate a chargeback, resolution may take longer. We may provide transaction information to your bank/card issuer to respond to chargeback claims.

 

 

8. SHIPPING, DELIVERY AND EXPORT

8.1 Dispatch. Orders are dispatched from Ecuador by or on behalf of the Seller using carriers such as FedEx, DHL, UPS, or similar providers.

8.2 Delivery estimates. Delivery estimates are not guarantees and may be affected by customs, weather, carrier disruptions, peak periods, or other factors outside our control.

8.3 Export documents. Shipment documents (including commercial invoices) may identify the Seller as exporter/shipper, and may be used for customs clearance.

8.4 Risk of loss. Risk of loss or damage passes to you on delivery to the address you provided, unless mandatory law requires a different result.

 

 

9. DESTINATION RESTRICTIONS (UNITED KINGDOM)

9.1 No UK direct-to-consumer sales. The Site is not intended for direct‑to‑consumer sales into the United Kingdom.

9.2 UK orders. We may block, refuse, or cancel orders with a UK delivery address. If a UK order is placed inadvertently, we may cancel it and refund the payment.

 

 

10. DUTIES, TAXES AND CUSTOMS

10.1 Import charges. Prices shown on the Site may exclude import duties, customs charges, VAT/GST, brokerage, or similar charges imposed by your destination country.

10.2 Customer responsibility. Unless stated at checkout that duties/taxes are prepaid, you are responsible for paying them. If you do not pay, delivery may be delayed or the shipment returned or disposed of by the carrier/customs; refunds may be reduced by actual costs incurred.

 

 

11. RETURNS, REFUNDS AND EXCHANGES

11.1 Policy. Returns and refunds are handled under the Returns/Refund Policy posted on the Site.

11.2 Coordination. ECUALAMA INC may coordinate support and communications on behalf of the Seller, but the Seller remains responsible for the sale contract and fulfilment obligations, subject to applicable law.

11.3 Timing. Refund timing depends on inspection, processor timing, and your bank/card issuer.

 

 

12. CUSTOMER SUPPORT

Contact: info@ecualama.com. If you need Seller legal details for an order, we will provide the Seller identification that applies to that order (as shown at checkout/invoice) in a reasonable timeframe.

 

 

13. INTELLECTUAL PROPERTY

13.1 Ownership. The Site and its content are owned by or licensed to ECUALAMA INC and are protected by IP laws.

13.2 Limited licence. You may use the Site for personal, non-commercial shopping purposes only.

 

 

14. PROHIBITED USES

You must not misuse the Site, attempt unauthorised access, introduce malware, scrape data, or use the Site unlawfully. We may suspend or terminate access for prohibited use.

 

 

15. DISCLAIMER OF WARRANTIES

To the maximum extent permitted by law, the Site and platform services are provided “as is” and “as available”. We do not guarantee uninterrupted or error-free operation.

 

 

16. LIMITATION OF LIABILITY

16.1 Platform scope. ECUALAMA INC’s responsibility under these Terms relates to the operation of the Site and platform services, not the manufacture or physical fulfilment of Goods.

16.2 Indirect losses. To the maximum extent permitted by law, ECUALAMA INC is not liable for indirect, incidental, special, or consequential damages.

16.3 Cap. To the maximum extent permitted by law, ECUALAMA INC’s total liability arising out of or relating to the Site will not exceed the amounts you paid through the Site in the three (3) months preceding the event giving rise to the claim.

 

 

17. PRIVACY

Personal information is handled under the Privacy Policy posted on the Site.

 

 

18. CHANGES TO THESE TERMS

We may update these Terms from time to time. The “Last updated” date shows when changes were posted. Continued use of the Site after changes means you accept the updated Terms.

 

 

19. GOVERNING LAW

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules, to the extent permitted by applicable law. Mandatory consumer protection rules in your country of residence may apply and cannot be excluded.
